Student Rights and Protections

• Hold a public hearing by the eighth week of school and adopt a Resolution on Sufficiency of Instructional Materials.

• Maintain clean, safe, and functional facilities (measured with the Facility Inspection Tool).

• Ensure students are not taught by misassigned or uncredentialed teachers for extended periods.

• Post the Williams classroom notice and maintain Uniform Complaint Procedures specific to Williams.

• Report Williams complaints quarterly to the Board and in each school’s SARC.

• If you believe your child’s school is missing textbooks, has an unqualified teacher, or unsafe facilities, you may file a Williams Complaint.

• You will receive a response compliant with Uniform Compliance Procedure timelines. Retaliation is prohibited.

• Post policies prominently in schools and make them available on the district website.

• Designate and publicize a Title IX coordinator.

• Provide notice of nondiscrimination to students, staff, and families.

• Maintain a prompt, fair, and equitable complaint process.

• Offer supportive measures to involved parties and protect against retaliation.

• Train staff on rights, responsibilities, reporting, and investigation practices.

• How to report: Students, families, and staff may report Title IX concerns to the district Title IX coordinator in person, by phone, by email. Reports may be made at any time. Evergreen School District contact information is listed under the Contact heading in the right column of this webpage. 

• What happens next: The district offers supportive measures, reviews the report, and determines next steps under its grievance process.

• Investigation and outcome: Trained personnel conduct a prompt, impartial, and thorough investigation, share findings, and issue a written determination.

• Appeals and protections: Parties are informed of any appeal options. Retaliation is prohibited, and privacy is protected to the extent permitted by law.

• Ensure compliance with applicable state and federal laws and regulations.

• Use UCP to receive, investigate, and resolve covered complaints at the local level.

• Annually notify students, employees, parents and guardians, district and school advisory committees, appropriate private school officials or representatives, and other interested parties about UCP. (5 CCR 4622)

• Protect parties from retaliation and maintain privacy as permitted by law.

• Track timelines and issue written decisions within required time frames.

• Who may file: Any student, parent or guardian, employee, or community member.

• Where to file: Submit a written complaint by email to the Evergreen School District Uniform Complaint Procedures contact  listed under the Contact heading in the right column of this webpage. 

• When to file: Discrimination, harassment, intimidation, or bullying complaints should be filed within six months of the alleged occurrence.

• How the district responds: The district offers appropriate supportive measures, conducts a prompt, impartial, and thorough investigation, and issues a written decision.

• Timeline: The district provides a written response within 60 days of receiving the complaint, unless an extension is agreed upon in writing.

• Appeal rights: If you disagree with the district’s decision, you may appeal to the California Department of Education within 15 days of receiving the decision.

• Civil remedies: Complainants may seek civil law remedies, such as through local mediation centers or legal assistance agencies. In discrimination cases, the complainant has the right to pursue civil remedies at least 60 days after filing an appeal with the California Department of Education.
